Late Fees Moratorium on Rental Units through the End of February 2021

Governor Jared Polis extended his late fees moratorium on residential and commercial units through the end of February 2021.

 

We have been getting a lot of questions also on the current status of the eviction moratoriums.  The Eviction Process currently is as follows:

 

10 DAY DEMANDS

If moratoriums do not apply, then normal demand time frames - 10 Day / 3 Day / NTQ by statute (CeglianLaw Forms and Legal Updates)

 

30 DAY NOTICE TO VACATE (CARES AND POP)

  1. CARES Act properties (Section 8 tenants/Project Based Housing / Property Owner’s Protection program beneficiaries– 30 day Notice to Vacate required) (CeglianLaw Forms and Legal Updates)
  2. CARES Act Affidavit required FROM CLIENT IN ALL CASES, WHETHER OR NOT CARES ACT APPLIES (CeglianLaw Forms and Legal Updates)

 

CDC DECLARATION RECEIVED FOR NON-PAYMENT CASES / EVICTION MORATORIUM

  1. CDC DECLARATION – Defense to non-payment evictions – [Need Contested Hearing to Challenge Fraudulent Declaration - only with clear & convincing evidence]
  2. CDC ATTESTATION required FROM CLIENT -  IN ALL CASES, WHETHER OR NOT CDC APPLIES (CeglianLaw Forms and Legal Updates)

 

NOTICE?

Polis’s Order mentions “Notice” of the CDC Order/Declaration Form, but his Order does not expressly require you to provide the CDC Order/Declaration as before.  You may, however, if you prefer.
