NEW CRITICAL EVICTION LEGAL UPDATE - POLIS ORDER 2021 088 = 30 DAY DEMANDS AGAIN

POLIS ORDER TO 30-DAYS FOR NON-PAYMENT DEMANDS

On April 20, 2021, Governor Jared Polis issued another Eviction Executive Order, D 2021 088 (Full Document), which again requires serving 30-day Non-Payment Demands (Document) instead of 10-day Non-Payment Demands.  This Order is in effect until May 20, 2021, unless continued, and applies to all unpaid rent accrued back more than a year ago to March 10, 2020.

 

REQUIRED Consumer Financial Protection Bureau (CFPB)  NOTICE

You will need to start including the CFPB Notice (Document) as part of your Money Demands.  Per my email below, attorneys cannot file evictions unless we have proof that the CFPB Notice was provided to residents with Non-Payment Demand Notices.  This Order does not take effect until May 3, 2021, but would apply to all money demand notices served before filing.   Accordingly, it is imperative to start serving the CFPB Notice now – with Money Demands/Non-Payment Demands – or your evictions will be postponed because you will have to start with a fresh money demand.  This CFPM Notice is NOT REQUIRED for all other types of Notices and Demands not related to non-payment of rent or other debts.
